THINGS TO KNOW!

Divorce:

There are three main parts to a divorce.
The first part is the division of property. This includes all assets accumulated during the marriage and it also includes all of the debt. The parties often negotiate many of these items. Ultimately if the parties cannot agree, a hearing is held where the Judge will make the decision.

The second part is custody. All minor children under the age of 18 are subject to a divorce proceeding. Again, the parties often agree as to visitation and custody issues. If agreements cannot be made, a Final Hearing will be conducted so that the Judge can hear the evidence and make his or her decision regarding custody.

The third part of divorce is child support. Child support is based on monthly income and applied to the number of children that is due support. The percentages are directly from State Law are applied to the monthly income of the obligor.

Custody, Visitation, and Access:

If you have a child with someone and they are not sharing in the upbringing of this child, you have certain rights. You can petition a Court to allow you to have access to your child. Visitation schedules and exchange arrangements are easily negotiable. The Courts have many programs designed to assist in these types of situations.

If you feel like the mother or father of your child is not setting a good example of for your child, you can petition the Court to change the living situations. The Courts will always look for one thing, THE BEST INTEREST OF THE CHILD!

Pre-Marital Agreements:

In today’s world, relationships change in an instant. We provide pre-marital agreements which protect the assets of both parties involved. We cater to those who would like to separate their assets such as bank accounts, credit cards, vehicles, and real estate before community property laws attach.
